Appendix 5- Sexual Violence and Harassment Policy

Sexual Violence Policy (a) Unionville College of Business, Health & Technology is dedicated to offering its students an educational setting free from sexual violence, treating those who report such incidents with dignity and respect. (b) Unionville College has implemented this Sexual Violence Policy, detailing sexual violence definitions and describing its approach to training, reporting, investigating, and disciplinary actions regarding student-reported sexual violence incidents on campus or at college events. (c) Individuals accused and reporting sexual violence will be designated as “Respondent” and “Complainant” respectively.

Definition of Sexual Violence (a) Sexual violence is defined as any sexual act or act targeting a person’s sexuality, gender identity, or gender expression without consent, encompassing sexual assault, harassment, stalking, indecent exposure, voyeurism, and sexual exploitation.

Training, Reporting, and Responding to Sexual Violence Unionville College will:

  • Include the Sexual Violence Policy in contracts with students, and distribute it to management, instructors, staff, employees, and contractors, ensuring understanding of policy and procedures for reporting and addressing sexual violence.

  • Ensure entities offering student internships comply with all relevant laws, including providing access to sexual violence policies.

  • Publish the policy on its website and mandate that any incidents or complaints of sexual violence be reported to the Campus Director.

  • Keep involved parties’ information confidential, except when disclosure is necessary for safety or legal reasons.

  • Recognize the right of Complainants to not report or participate in investigations, while also acknowledging circumstances where the college must act independently of consent for community safety.

  • Provide affected students with support, including counseling and medical care, without the requirement of a formal complaint.

Investigating Reports of Sexual Violence Investigations will involve:

  • Written reports or complaints made to the Campus Director.

  • Immediate response procedures, including decisions on investigation participation, investigation conduct, police referrals, and interim safety measures.

  • Comprehensive investigation processes, ensuring fair opportunities for all parties to participate and provide evidence.

  • Determinations post-investigation regarding the occurrence of sexual violence and subsequent disciplinary actions.

 

Disciplinary Measures Appropriate actions, including employment termination or student expulsion, will be taken against Respondents found to have committed sexual violence.

 

Appeal Disagreements with investigation outcomes can be appealed to the Regional Director within 10 days of the decision.

 

Making False Statements False complaints or information regarding sexual violence are violations of this policy, subject to disciplinary actions.

 

Reprisal Retaliation against Complainants or participants in the investigation process is prohibited and subject to disciplinary actions.

 

Review Unionville College commits to involving student input in the development and periodic review of its Sexual Violence Policy, with reviews at least every three years.

 

Collection of Student Data Unionville College will collect and provide data as required by regulatory authorities, demonstrating compliance with relevant legislation.
